Treaty of Bern/Constitution of the Universal Postal Union[edit]

I'm trying to figure out what the correct number of parties to list for this treaty is. There are two complications. Of the 192 UPU members, there are:

  • 2 dependencies
  • 4 states that are listed as not having ratified the constitution (Honduras, Dominican Republic, South Sudan, Sudan) [1][2][3][4]

The article argues that the dependencies didn't independently ratify the agreements, so they shouldn't be counted separately, and I think this makes sense. However, the second point is more interesting.

Basically, as I understand it, when the Treaty of Bern was superseded by the Constitution of the UPU in 1964, it specified that (A2) "countries which have membership status at the date on which the Constitution comes into force" would continue to be members. Thus, three states (Honduras, Dominican Republic, Sudan) which were members of the UPU by acceding to the Treaty of Bern, signed the constitution and continued to be members of the UPU despite having never ratified the constitution. However, according to [5], "the absence of formal ratification of the Acts of the UPU did not deprive countries of their membership or of their right to attend and vote at Congresses. It was considered that the Acts were “tacitly ratified” by the implementation of the new provs". So they are treated as members due to their "tacit ratification", but formally aren't parties to the Constitution.

With regards to the fourth state (South Sudan), I presume this is a mistake. The Constitution says (A11) "Accession or application for admission to the Union must entail a formal declaration of accession to the Constitution". So presumably they must have acceded, (and this says they did), even though they are not listed as having done so here.

So the question is, what number should we list? Given that the Treaty of Bern is no longer in force, I think we should only count the number of parties to the Constitution which have formally ratified the agreement, with a note explaining the "tacit ratification" of the three others. UNESCO Treaty US/Israel withdrawal[edit]

I have added a comment mentioning the withdrawal of the US and Israel. Not fully sure of the effect of those withdrawals on the UNESCO Constitution. In my opinion the number of parties should be reduced to 193 (from 195). Any thought? Alpha322 (talk) 14:54, 2 October 2022 (UTC)[reply]

 Palestine has ratified the Vienna Convention and the Montreal Protocol about the Ozone Layer[edit]
