Rio Grande do Sul[edit]

Hi Luiz! I've noticed that you've removed Rio Grande do Sul from the list of jurisdictions recognising same-sex civil unions or registered partnership. I'd like to know more about how the law recognises same-sex couples in this state. Numerous media sources state that Rio Grande do Sul has "civil unions". For example, 365Gay.com, states that "In neighboring Brazil, Rio Grande do Sul state which lies along the border, passed civil union legislation in 2004, two years after Buenos Aires passed a similar law." This source from the BBC also goes more in depth about the process. It states that "The ruling [by the Court in Rio Grande do Sul] binds all judges and justices-of-the-peace in the state to approve civil unions 'between persons of sound mind and independent of sexual orientation'". Doesn't this mean that any same-sex couple can apply for a civil union and gain the rights inherent in this? Thanks, Ronline ✉ 01:59, 10 April 2009 (UTC)[reply]

Thanks very very much for the information! So, is it correct to say that all over Brazil, same-sex couples can record/register their relationships? I just have a few more questions:

Who records these relationships? (Is it a state/government agency?)
What rights does a same-sex couple have once they have recorded their relationship?
Are these civil contracts similar to the PACS in France and Civil unions in Portugal?
What is the difference between these civil contracts and the national Civil Union scheme proposed by Brazilian Congressional Bill No. 1151?
According to Recognition of same-sex unions in Brazil, same-sex partners are recognised as "stable unions", and are afforded some federal rights of marriage (e.g. social security, immigration, etc). Is this different to the civil contract described above, or is the "stable union" created by the partners signing a civil contract and depositing it at the notary?

If it is correct that same-sex couples all over Brazil can locally register their unions, then Brazil should appear in the "registered partnerships" section of the template, rather than "unregistered cohabitation".
