Fair use rationale for Image:The Wraith (DVD cover).jpg[edit]

Image:The Wraith (DVD cover).jpg is being used on this article. I notice the image page specifies that the image is being used under fair use but there is no explanation or rationale as to why its use in this Wikipedia article constitutes fair use. is this movie really in the public domain? what is the reference to the true events in nevada that this movie is based on

It's obvious from just watching the movie that at least one replica shell was made for a head on crash. The car disintegrates on impact, there's nothing left but chunks of fiberglass and the wheels can be seen mounted to minimalistic, lightweight 1" square tube frames.
