Profile image inclusion and Fair Use rules[edit]

This profile image was uploaded for the specific purpose of serving as the main illustration on a biographical article on Richard Felix Staar. The image appears to be from a non-free source, and a Fair Use rationale was provided. Recently the image has been removed from the article arguing that the image does not fulfill Non-free content criteria #1: No free equivalent (@Hullaballoo Wolfowitz:, please weigh in). When I originally uploaded the image I searched for potentially free images, and I found none. If someone has better information on free equivalent images, please do say so. Otherwise, I recommend keeping using this image in the article. Also, if the community still believes that it does not fulfill the NFCC#1, I would appreciate an explanation of why, because in good faith I don't see why it does not qualify. First, it is an obvious violation of NFCC#1, as a nonfree image of a living person, and there is absolutely no reason to believe that any of the very limited exceptions to that prohibition apply. Second, since the subject was appointed to a notable federal government position, and also received a notable federal honor, it should be strongly presumed that a free image -- created by the US government -- is available for use. Not being able to find a free image online is, by policy and consensus, not alone sufficient to justify inclusion of a nonfree image. The Big Bad Wolfowitz (aka Hullaballoo).
