removed: Section 213(d) of the Criminal Code of Canada did not violate ss. 7 or 11(d) of the charter, and therefore, was not saved by ss. 1. Although s. 213(d) challenged individual liberty and security of person under ss. 7, it did so in accordance with fundamental justice. RSC 1985, c 27 (1st Supp) s 40(2). This needs to be expanded or explained because it seems to contradict the court's finding.
