Dissent between long term members of the Board of Directors the management of the sanctuary by Chairman of the Board of Directors and recently hired (in November 2021) President Shelly Lakly began in the spring of 2022. This erupted in August of 2022, when the long-term Animal Husbandry Manager, Allison Hedgecoth, was suspended for 30 days without pay for participating in a rescue of wolf hybrids and long-term attending veterinarian Dr Karen Thomas was removed from the board of directors in the beginning of an apparently hostile board takeover by new President Michelle Lakly and Board President Glenn S. Ross. This suspension and removal of the attending veterinarian occurred at the beginning of an avian influenza outbreak, resulting in disruption of established avian influenza management protocols, the death of hundreds of wild vultures, and the ultimate euthanasia of over 100 sanctuary birds.

On August 18th, 2022, Senator Emmanuel Jones held a hearing in Atlanta about ,management and safety concerns expressed by former employees and local residents due to the actions of President Lakly and the mismanagement of the board of directors by Chairman of the Board Glenn S. Ross.

Highly Pathogenic Avian Influenza was confirmed by the Georgia Department of Agriculture and a minimum 5-month quarantine was imposed by the GDA in an attempt to control the spread of this virus.

The management of the Avian Influenza outbreak by President Lakly and Chairman of the Board Glenn S. Ross resulted in employees walking off the job citing concerns over both animal and human safety.

In November 2022, Senator Emmanuel Jones continued to question the management of Noah's Ark by President Lakly and Chairman of the Board Glenn S. Ross in the light of the worst USDA Inspection report ever given to the sanctuary from a USDA-Aphis inspection on September 15, 2022. This cumulated with a virtual press conference to discuss these concerns with the board of directors and President Lakly, but they did not respond to requests for discussion.

The USDA-Aphis inspection in September 2022 cumulated in an Official Warning on November 9, 2022, for failure to dispose of dead vulture carcasses among other unsanitary conditions in animal enclosures after the large vulture die off that occurred in August, 2022. A week later a bear bit a volunteer attempting to provide medication on November 18, 2022, cementing former employees’ concerns over human and animal safety.

On December 9th, Founder Jama Hedgecoth, former board member and Attending Veterinarian Karen Thomas and two other former board members that were removed by Chairman of the Board Glenn S. Ross filed a lawsuit against Chairman of the Board Glenn S. Ross, President Lakly, and remaining board members alleging illegal activities, a hostile takeover of the sanctuary, illegal termination or removal of all founding family members, and management of the sanctuary that strayed from its mission statements.

Noah's Ark was hit by a tornado on January 12, 2023, resulting in downed trees and damage to buildings and animal habitats.

In February 2023, the moving of beloved hoofstock resulted in further public outcry as horses, cattle, sheep and goats were moved off of sanctuary grounds. A statement from President Lakly, Chairman of the Board, Glenn S Ross and the current board of directors stated that they had decided to remove and rehouse several livestock based on issues of safety and medical care claiming that the Georgia Department of Agriculture and the Henry County Animal Control recommended they rehouse the animals, but this is something both entities deny doing.

On March 23, 2023, a 60-day letter of intent to sue by Outreach for Animals, Inc and Dr Karen Thomas was delivered to President Lakly and Chairman of the Board Glenn S Ross and the remaining board members alleging their mismanagement and failure resulted in several violations of the Endangered Species Act, specifically placing 31 specific animals living at Noah's Ark that are protected by the Endangered Species Act in danger.
