Was he technically president of the United States for a day?[edit]

President Monroe and Vice President Tomkins refused to take the oath of office and instead took the oath on the fifth. Thus, it may have been possible that Gaillard was president during the gap of March 4-5, 1821.Ericl 18:27, 31 December 2006 (UTC)[reply]

Gaillard was NOT President during that time. James Monroe had been President since March 4, 1817. There is no reason to suggest Gaillard should have assumed Presidential duties and it would not be possible to say he was President. Did Gaillard take the oath? No, of course not, because Monroe was President. Monroe started his second term at noon on March 4, 1821 regardless of when he took the oath. Jjmillerhistorian 22:04, 31 December 2006 (UTC)[reply]

A similar and more frequent question was raised regarding David Rice Atchison's alleged service as Acting President in 1849 in which it has been determined that Atchison could not have served as Acting President.--TommyBoy (talk) 22:15, 13 May 2017 (UTC)[reply]
