I ask you this:

"He is generally regarded as a representative of American legal realism" - Says who?

"and is famous for his statement that the principle of stare decisis is no longer applicable" - He's more famous for criminalizing cannabis, but that is almost as POV as the original wikipedia statement of what he's famous for.

"Although the approach could be implemented in a time when society was relatively simply structured, in the present age it should be abandoned" - Herman Oliphant revised many of his statements. Interesting that this is put forth as his defacto view.

"To this effect, Oliphant pleaded a scientific approach" - Says who? Who called it "Scientific"?


"You have made fair points about the Herman Oliphant article. But as I have said, that a different article contains poorly referenced, or even unencyclopedic content..." - Mike Rosoft

Well, Mike Rosoft, if you were "fair" you would act towads this article as you did towards the paths of tiferet image.

Let's be "fair". You have a delete key and you know how to use it Mike Rosoft. Same goes for any other admin.

Wow, this page just recieved a nice little note saying it might need work, definitely a good start. Interesting that cannabis/hemp related insight is basically on auto-delete by certain admins (even on discussion and talk pages) while this page and many others will live nice long lives of complete BS. According to a quote from this] web page, he is on page 16 of Naturalizing Jurisprudence "commonly thought to be a Realist". Also, at least according to the google results on his name, the pages linking to his legal theories show up first, so I tend to think that there is some justification for saying he might be more famous in at least legal circles for his legal opinions. While he is also mentioned in regards to his hemp related activities, those appear lower on the google search results list. John Carter (talk) 21:57, 11 February 2008 (UTC)[reply]

About that quote you had, the page that you quoted to verify that Herman Oliphant was a "Realist" is good, but it also points out that the "Realism" movement, to many qualified people, does not exist. I think you will find that Herman Oliphant was a lot of things to a lot of people in a lot of published sources. It's a matter of who's POV suits the wikipedia admins personal preferences and there is no way around it as far as I can tell. (Still, I must add that wikipedia is the best encyclopedia that I am personally aware of, and as an avid FOSS software supporter I feel that wikipedia has more integrity than would be possible in a “closed source” community. --TaylorOliphant (talk) 06:56, 12 February 2008 (UTC))--TaylorOliphant (talk) 22:14, 11 February 2008 (UTC)[reply]

Agreed. But, if there is a verifiable source that calls him that, we can fairly describe him that way. I actually didn't have time to go through the whole google search list earlier, but I can try to finish that tomorrow or tonight. If you've got verifiable sources on any other aspects of the subject, though, as long as they don't wind up violating WP:Undue weight, which at this point is unlikely, feel free to point them out or add them yourself.
