Los Angeles Times Article[edit]

There was a Los Angeles Times article on October 27th, 2010 titled "Lieutenant Governor Abel Maldonado's farm cited for safety violations". The article was less than complimentary. Lieutenant Governor[edit]

If I understand the California Constitution correctly, Maldondao (by virture of not being elected LtG in November 2010) is no longer Lieutenant Governor as of 11:00 AM PST today. Doesn't the State Constitution have the final say? GoodDay (talk) 22:30, 3 January 2011 (UTC)[reply]
I don't know. All we can go by is what reliable sources are reporting. The State's web site still has Maldonado's name at http://ltg.ca.gov, and the scant few sources that are reporting anything on the matter are saying he's remaining until Newsom is sworn in, and they are saying that date is TBD. Whether this would turn into an actual lawsuit/crisis at some point if this were to drag on longer than that is anyone's guess. (See Richard Ravitch, circa 2009, for example.) I know you've been around long enough to know that we don't interpret legal documents around here...you may well be correct that he is no longer LTG of CA, but that's not what is available to us in reliable sources.  Frank  |  talk  22:37, 3 January 2011 (UTC)[reply]

It is a WP:PRIMARY source. We found out in Bush v. Gore, United States Senate election in Minnesota, 2008, and 2009 New York State Senate leadership crisis, among other recent, memorable cases, that there is interpretation of these things. The reality right now is that reliable sources are reporting Maldonado is still the Lt. Gov of California. It may be non-sensical, but I don't know of any Wikipedia policy that would support us stating otherwise. If you do, please cite it. I can be convinced. Beside the point. It's a primary source and it is not the final answer on the matter. Remember that Wikipedia is about verifiability, not truth. There is no Wikipedia policy that allows us to interpret the CA Constitution to draw the conclusion that Maldonado is no longer the Lt. Gov of CA, and we do have reliable sources that state that he remains Lt. Gov. You may be 100% correct that the constitution states otherwise, but that doesn't mean he no longer holds the position. I really don't know; I'm going by what the reliable sources are reporting. And clearly it's a grey area. For example, if you go to http://gov.ca.gov, there is no link at all to the lt. gov's page. But if you go to http://ltg.ca.gov, there is a link to the gov's page...except it has Arnold's picture. So it points to the right place but has not been updated. So the people in state government there know what's going on...which is that it's an unusual situation. It is precisely because the constitution is a WP:PRIMARY source that it is problematic to use it. It's not "the primary source" but rather a WP:PRIMARY source - and as such, not suitable as an only source. We have others that say differently.  Frank  |  talk  23:08, 3 January 2011 (UTC)[reply]

I have undone that edit; you do not have WP:CONSENSUS for it, either here or at Talk:List_of_Governors_of_California. Please understand - I am not saying I have any opinion on whether or not he is still the Lt. Gov of CA, nor am I "interpreting" the Constitution of CA. For the record, there is no Section 16 in Article V of the California Constitution.http://www.leginfo.ca.gov/.const/.article_5 Furthermore, there is nothing about 11:00 AM whatsoever. Indeed, this is why Ronald Reagan was sworn in as Governor a few minutes after midnight, as his predecessor, Pat Brown, remained Governor until his successor (Reagan) took office.See bottom of page 172 to top of page 173 of Governor Reagan: His Rise to Power by Lou Cannon.
