1. This is a copyrighted photograph of a deceased individual for whom no free use alternative exists. 2. The individual is of historical importance and is deceased. 3. This is a low resolution rendition of the original, copyrighted in 1924. Any potential value of the original high-resolution image is not affected. 4. This image is to be used for identification purposes in a non-profit encyclopedia article of the subject at Wikipedia. 5. The photographer is unknown, now long dead, and there is no way to obtain permission from the photographer's literary heirs. This presumes the image is still under copyright, which it may well not be. 6. Only a small portion of the complete image is used, perhaps 5%.
