  • Keep The image page used to carry a non-free tag and a fair-use rationale. Jbolden1517 (talk · contribs) disputed the fact that these are necessary, and removed them. There is discussion of the matter on the image's talk page.   • KeepThis is a photo I took, and as far as I can see, it falls under the fair use category: It is a non-commercial usage for educational purposes (this is the reason for encyclopedias, is it not??). Gila Brand has granted Wikipedia a GFDL license based on her creation of the work she's asserting asserting unencumbered copyright. If it were fair usage in terms of copyright she's be committing fraud. So I think her statements here are clear. She then uses the term "fair usage" when she makes a long case of why she believes its not a trademark violation: educational, not commercial. no attempt to mislead... Those are defenses to a trademark violation not a copyright violation. They aren't defenses to fair usage with respect to a trademark violation however. (She's not an American so its reasonable if she doesn't quite grasp the issue). So trying to turn her statements into something cohesive:

  1. She has asserted sole ownership of copyright (i.e. no fair use here)
  2. She has asserted that there is no trademark violation because of a wide range of reasons
  3. She has incorrectly classified those reasons as fair usage

I suggest you ask her directly. All I can say is that weeks ago after she uploaded the image, I informed her of my concern that it may not be entirely free and suggested she add an additional {{logo}} tag, which she then did. nadav 03:35, 14 May 2007 (UTC)[reply]

There is not enough of the newspaper shown to require a {{non-free newspaper image}} tag (because you can't make out any of the stories), and there is no way those logos qualify for copyright protection -- this cannot possibly meet the threshold of originality (a word in a certain font is not copyrightable). howcheng {chat} 07:03, 14 May 2007 (UTC)[reply]

    • Perhaps. We probably could. The truth is that a lot of logos feature very little original creativity. This is, indeed, why logos are primarily protected by trademark law, not by copyright. (For purely textual logos like this one, the issue might be further complicated by the peculiar copyright status of fonts in the U.S., but that, as I understand it, would generally only make such logos less eligible.) Of course, that doesn't stop companies from trying to claim copyright on them anyway. In cases such as the LA Times logo, we lose little by humoring them and assuming that such a claim could be valid, since we have no interest in creating derivative works based on them, or otherwise using them, in ways not covered by fair use and our policy thereupon. For the newspaper image discussed here, however, I believe the reasonable thing to do is to acknowledge and assert that not only is there little copyrightable material visible in the image, but that any such material as there may be is incidental, limited and/or transformed enough to count as fair use / fair dealing within the free image under any reasonable jurisdiction, much as the LA Times logo counts as fair use within the freely licensed work that is Wikipedia.   • Comment All I had wanted was some sort of tag to indicate that it's a trademark, since I agree that there is not enough material from the newspaper to be considered copyrightable. I had thought that {{logo}} was the only tag for this, but DHowell has now placed the more appropriate {{trademark}} tag. To me, this issue is now resolved. nadav 23:27, 14 May 2007 (UTC)[reply]

This was the second of two images of an ancient coppice of a Sweet chestnut which I removed subsequent to a complaint of there being too many images in the article "Coppicing". The first of the images of the above-mentioned ancient coppice stool (but seen from the opposite side) remains in the article. It was originally intended to give a proper impression of what such a coppice looks like. Seems a pity that you should want to remove it altogether, it is graphical evidence after all. I changed it already to not show the company name (company that does a lot of case studies involving heat maps) for the reasons mentioned by user:here. I kept the reference to the company for the image itself since the policies of Wikipedia regarding images tightened significantly. Some could argue that the modification of the promotional material that falls under fair use is so significant that I could claim it as my own and release it into the public domain, but I am not a lawyer. I can't use real head maps, because that would violate somebodies copyright. By using this image, fair use can be applied and credits are given too, but not highly visible (not in the article). This is a POV of (User_talk:Abu badali and I respect, but strongly desagree. In fact, this is a pivotal scene in the film, probably the only one in that human beings as seen as what they are suposed to be, human beings. Abu Badali didn't see the film, I bet, and shows he has zero sensibility to arts. He's just a burocrat, it's ok. The relationship among these two men in a brief moment of the film is what all this picture is about. Hope inside the Hell. No one is all bad, no one is all good. Deleted. First of all, according to the image description page, this isn't even a photo of the actual event, but a staged reproduction (and this statement is unsourced). Second, it has not been adequately explained why this specific photo is necessary either here or in the six (!!) articles that it can be found in (Invasion of Poland (1939) is really the only valid location for the image). The event itself may be notable, but the photo is not. Yes, it may be widely reproduced in history textbooks, etc, but is it like Raising the Flag on Iwo Jima? I'm not saying the event in question isn't notable. I'm saying this particular image isn't. Even if it was a notable image (won some prize, etc.), it should be used to discuss the notable image itself, not not the event it depicts. Therefore what you are saying is that many articles, where no photographers from US or UK government, or Soviet Union were present, should not have a single photo... Source info only says the image is either from ww2.pl or solidarity.gov.pl, but gives no link for this information to be verified. When I see this particular image I know where to place it within historical contexts, but am still amazed that humans can do the things these men did to other people. The source of this image is Jürgen Stroop's report to Reichsführer-SS Himmler ¨Es gibt keinen jüdischen Wohnbezirk in Warschau mehr!", dated May, 1943. The report was captured by the USA and submitted as evidence to the International Military Tribunal, Nuremberg, as US Exhibit 275. It was transferred to the Polish government sometime between 1947 and 1951. The original photograph was, therefore, certainly taken by a German (SS or police) photographer and published over 50 years ago. I also agree that it is one of the iconic images of the uprising.
