Freedom of panorama does not apply under Danish law for photographs of works of art in public locations, provided that the original work of art constitutes the central element of the resulting photo, and that any such photo is used for commercial purposes (cf. the Danish Copyright Act § 24, 2). This image is consequently incompatible with Commons' rules and similar images have already been deleted there.

In addition, the descendents of this particular artist are known to file law suits demanding financial compensation whenever the statue is used in commercial contexts. Images like this one will remain protected by copyright under Danish law until 2030, as Edvard Eriksen died in 1959. See a warning printed in a magazine for professional journalists (in Danish)).
