In Higgins v. Keuffel, 140 U.S. 428 (1891), the Supreme Court held that a simple word label without artistic ornamentation could not be copyrighted. See to the same effect Kitchens of Sara Lee, Inc. v. Nifty Foods Corp., 266 F.2d 541, 544 (2d Cir. 1959). This is such a label: a short phrase.
