1) The yashmak is a unique showpiece design. Any duplicate would be an obviously inferior knock-off, and using a photograph of one would be misleading to the reader.

2) The yashmak was a haute couture one-off, never commercially mass-produced. It is not possible to simply purchase it to photograph it. 3) The original yashmak is no longer extant, and the replicas held at the V&A and The Met respectively are not on public display, so it is not possible to simply go to a museum and photograph it.

1) The yashmak itself is not (and was never) commercially available, so a photo of it can't harm Shaun Leane's or McQueen label's ability to profit from the design. Even if it was, a simple photo can't replace the actual ensemble.

2) The last museum exhibition the yashmak appeared in closed in 2018. The use of the photo cannot detract from ticket sales for a long-closed exhibit. 3) The photo is publicly and freely available on the museum's website.
