Fair use in California Style Manual[edit]

Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

  1. The image constitutes a facsimile of an official publication of an order of the Supreme Court of California, whose opinions "shall be available for publication by any person" per Cal. Const. art. VI § 14

. The Supreme Court has not delegated a license to the fourth edition of the California Manual, and the entire document has been made freely available online by the Sixth District Appellate Project.

  1. The image is used as the primary means of visual identification of the article topic.
  2. The use of the cover will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original. In particular, copies could not be used to make illegal copies of the book.
  3. It is a low resolution image.
